San Miguel de Allende
Real estate lawyers for San Miguel de Allende: direct purchase by foreigners, historic-centre homes, INAH permits, boutique hotels and rentals.
San Miguel de Allende is one of Mexico’s real estate markets with the most foreign buyers, and one of the most distinctive: colonial homes in a historic centre inscribed on the World Heritage List, boutique hotels, vacation rentals and, outside town, ranches, country lots, and condominium developments. IBG Legal has no office in San Miguel de Allende. Matters here are handled from the firm’s Querétaro and Mexico City offices, with visits to the city whenever the file requires them.
Direct purchase, no mandatory fideicomiso
San Miguel de Allende lies outside the restricted zone, so a foreign buyer can take title in their own name by direct deed, without a fideicomiso (bank trust). What the law does require is that, before acquiring, the buyer file with the Secretaría de Relaciones Exteriores the agreement under which they are treated as a Mexican national with respect to that property and waive the protection of their own government. A trust can still be useful for estate planning, financing, or co-investment, but it is a structuring choice, not a requirement. Once the deed is signed, the purchase is recorded at the Guanajuato Public Property Registry office that covers the municipality, and the acquisition tax and property tax are paid to the San Miguel de Allende municipal government.
The historic centre and its rules
Buying or renovating a house in the centre adds a further layer of permits. The historic monuments zone is overseen by the National Institute of Anthropology and History (INAH), and works on heritage buildings need its authorization in addition to the municipal license; the municipality applies its own urban-image rules on façades, heights, colors, and signage. Before buying with plans to expand, convert a house into a boutique hotel, or open a business, confirm what each authority allows for that specific property. Vacation rentals add the tax obligations of the activity and the municipal licenses that correspond to the use.
