Puerto Aventuras is a master-planned community built around a marina, within the Solidaridad municipality, between Playa del Carmen and Tulum. Its market differs from the neighboring towns: gated homes and condominiums, units on the marina or the golf course, long-term residents, and owners who rent seasonally. IBG Legal has no office in Puerto Aventuras; matters in the community are handled from the firm’s headquarters in Cancún, with site visits when the file requires them.

Buying inside a marina community

Almost everything in Puerto Aventuras is bought within a condominium regime or a homeowners’ association, and those documents matter as much as the deed: they set assessments, use rules, vacation-rental rules, permitted works, and who manages the common areas. Before signing, review the current bylaws, recent meeting minutes, and a certificate showing assessments are paid up. Foreign buyers acquire through a fideicomiso (bank trust) authorized by the Secretaría de Relaciones Exteriores, because the community lies within the restricted zone.

Two features of this market need careful reading. The first is the boat slip: a berth in the marina is not always real property that can be deeded; it is often a right of use derived from the marina’s federal concession or from a contract with its operator, and its term and transferability depend on that instrument. The second is fractional or shared ownership, where what the buyer acquires may be a contractual right to use the property for set periods rather than a share of the real estate.

Authorities involved

Title and liens are checked at the Public Registry of Property and Commerce of Quintana Roo; property tax, construction licenses, and the local acquisition tax belong to the Solidaridad municipal government. Works on the coast or in the marina go through SEMARNAT and PROFEPA, and anything touching the sea or the beach through the federal maritime zone (ZOFEMAT) concession and, where applicable, the maritime authority.

Matters we handle

Review of community bylaws and statutes, title and assessment due diligence, restricted-zone fideicomisos, analysis of slip agreements and fractional-ownership contracts, rental management agreements and, when a dispute arises, representation against the condominium administration or the seller before the Quintana Roo courts. Complimentary initial fit assessment, subject to scope review.
